Reasons of DISMISSAL/ACQUITTAL of Cases
• Inconsistencies in testimony.
• Failure to preserve the identity and integrity of the seized items/failure to comply
with Sec 21 RA 9165.
• The idea to sell dangerous drugs emanated from the informant and not the
accused/instigation.
• Failure to present the cellphone/exchange of messages
• Failure to prove identity of corpus delicti
• Conflicting affidavit and testimony of affiants.
• No document/evidence was presented as to the illegal drug activities of the accused.
• Constitutional Rights of the accused were violated.
• Chain of custody is broken
• Grant of demurrer
• Lack of proper coordination with PDEA (ex. Another person was arrested, different
from the person stated in the Coordination Form)
