Monopolistic attitude of PA
in treating information:
• PA does not provide neither ensure access to raw
data
• PA defines as institutional new services so to
provide value added services
• PA charges the re use at very high and unjustified
prices
Cadastral and mortgage data
• The Land Register Office not only owns raw data, but provide
monitoring value added services
• Monitoring service has been declared “institutional” by law
• Private companies willing to render the same service and gain
access to the list of subjects shall pay a fee increased of the 500%
since 2006
• As a consequence companies have been obliged to cease
monitoring activity, with a loss of workforce of approximately 30%
Legal data
• Several attempts by PA, also in virtue of law
provisions, to set up infrastructures aimed to provide
the same value added services rendered by private
companies
• Such attempts allegedly made to provide free access to
citizens, in practice have always been addressed to
professional users fully overlapping publishers

How to optimise the re-use of PSI …
• Reasonable time limit to secure access to data
• Independent PSI regulators and efficient redress
mechanisms
• Asset lists
• Clear transparent and equal conditions for re-use

PSI Alliance goals
PSI Alliance’s membership is looking for
both a fair and level playing field in the PSI
marketplace,
that
enables
re–users
to
access raw data both at marginal cost and
with few restrictions and a more flexible
and efficient redress system

• We need better definitions of the public task
• Access to “raw data” is important for the
development of value added products
• Marginal cost based prices increases the re-use of
PSI ( compare the OECD agreement )
• Better re-dress solutions necessary

PSI Market value (27 billion in Europe)
PSI Market plays a key role in enhancing a knowledge
driven economy based on the exchange of information
This will ensure:
•real benefits for both the public and private sector and
final consumers
•economic growth and cost reduction
•advanced and innovative services to citizens and
enterprises
What PSI Alliance hopes
before the 2012 review?
• New market study on the economic and social value
of PSI – which included an analysis of the effects of
lower prices and access to data
• Setting up a PSI Market Observatory, similar to the
EU’s Single Market Observatory
How the Commission can help?
• Better guidance and sharper regulation
• Pressure upon MS in setting out implications and
obligations to ensure that barriers are overcome
• Discrimination, high charges, complex licencing policies
have to been remove so to increase competitiveness,
create new jobs unlock the full potential of PSI

First of all, who are we?
• Confindustria Servizi Innovativi e Tecnologici is the Italian Federation
that gives a common voice to all businesses that create technological,
professional, managerial, and organizational innovation.
• The Federation, organized in 45 Industry Associations and 62 Local
Organizations, represents 17,000 companies employing 600,000
workers.
• Altogether all the above sectors are a very significant part of the
economy representing 18% of the Italian GDP.

What are we doing in Italy?
Working closely with the Italian Government to:
•find solutions to remove barriers to re-use
•finalize fair and transparent licence agreements for
PSI re-users
•negotiate equitable and accessible prices
•define public tasks so to avoid anticompetitive
behaviours
The infringement procedure
• The Italian Government has obtained a time extension to
give the information requested by the Commission, now
expiring on the 23rd of July
• The reasons for the extension is due to the different
Italian Institutions involved
• We are keeping close contacts with the EU Affairs
Department of the Prime Minister’s Cabinet and relevant
PA Institutions
