James Madison
•
•
•
James Madison (March 16, 1751
– June 28, 1836) was an
American politician and political
philosopher who served as the
fourth President of the United
States (1809–1817), and was one
of the Founding Fathers of the
United States.
Considered to be the "Father of
the Constitution," he was the
principal author of the document.
In 1788, he wrote over a third of
the Federalist Papers, still the
most influential commentary on
the Constitution.
Judicial Review
•
•
•
•
•
Judicial review is the doctrine in
democratic theory under which
legislative and executive action is
subject to invalidation by the judiciary.
Specific courts with judicial review
power may annul the acts of the state
when it finds them incompatible with a
higher authority, such as the terms of a
written constitution.
Judicial review is an example of the
functioning of separation of powers in
a modern governmental system
(where the judiciary is one of three
branches of government).
This principle is interpreted differently
in different jurisdictions, which also
have differing views on the different
hierarchy of governmental norms.
As a result, the procedure and scope
of judicial review differs from country to
country and state to state.
Checks and Balances
• The Checks and
Balances control the
legislative branch,
executive branch and the
judicial branch.
• Created by Montesquieu.
• Checks and balances
allows for a system based
regulation that allows one
branch to limit another,
such as the power of
Congress to alter the
composition and
jurisdiction of the federal
courts
Electoral College
• Elects the president
and the vicepresident.
• Since 1964, there
have been 538
electors in each
presidential election.[
The 18th and 21st Amendments
• The 18 amendment
banned alcohol, then
it was legal.
• After a few years the
constitution decided
to ban alcohol and
that’s how the 21st
amendment
happened.
