Agricultural Preservation Ordinance
• Right to Farm Act (CA Civil Code § 3482.5) (enacted
in 1981)
• Farming activity cannot be a public or private nuisance due to
changing conditions around a farm if:

Commercial farm
Farmed consistent with “proper and accepted customs and standards”
Continue operation for three years
Not a nuisance at time it began
• The Act prevails over any locally-adopted contrary regulation.
• Local agencies may adopt regulations requiring notification to
prospective property owners of the proximity of agricultural
activities.

CA Right to Farm Act and Town of Windsor
Agricultural Preservation Ordinance
• Agricultural Preservation – Windsor Zoning Ordinance
Chapter 27.24
• Purpose is to protect agricultural operations uses
• Establishes buffer between urban development and existing
agricultural operations.
– Subdivisions and other development subject to discretionary land use
approvals:
• 100 foot buffer from property line for row and field crops.
• 200 foot buffer from property line for vineyards and orchards, or
less than 200 feet but in no case less than 100 feet with Council
approval based on certain mitigating factors.
– Projects not subject to discretionary land use entitlements (e.g. building
permit only), 100 foot buffer to all habitable structures.
• Establishes Disclosure requirements for property within 1000 feet.
