Laws Regarding Internet Safety
• CIPA = Children’s Internet Protection Act
– Implementation began July 1, 2004
– Schools and libraries must certify that they have an “Internet Safety Policy” in
place as defined in the law. This act mandates specific strategies to prevent
adverse computer use by school-age children. A school Internet Safety Policy
must address the following issues:
• Access to minors to inappropriate material on the Internet
• The safety and security of minors when using e-mail, chat rooms, and instant
messaging services
• Unauthorized access, including so-called hacking and other unlawful activities by
minors on-line

Laws
• In order to receive E-rate discounts, schools in Arkansas must be in compliant
with this act.
• Districts must send to the state a completed form 479 stating the status of
their compliance. The choices are
– In Compliance
– Undertaking actions to comply with CIPA
– CIPA does not apply because school is receiving discounts for Telecommunications
Services only.
• Schools must certify that they do the following:
– Created an Internet safety policy and distributed it to the school community.
– Implemented a technology – blocking measure to prevent schools from accessing
inappropriate material from all school computers. If not certified, they must be
undertaking measures to implement such technology.
– Conducted a public meeting to disseminate and discuss the school’s new or revised
Internet safety policy.
Arkansas Code State Law
• Arkansas Code State Law 6-21-107:
– Have a written policy concerning student and staff use of computers
owned by the district in accessing the Internet. Written policy
should include provisions for the punishment of violations of the
policy.
– Students should sign a computer use agreement form outlining
proper and improper use of public access computers prior to being
allowed to access the computer equipment.
– Technology to prevent students and staff from gaining access to
material that is harmful because of a filtering program. This should
include obscene and pornography Internet websites. (State 8e6 plus
Local Control)
