Parties to provide and/or facilitate access to
and transfer of technologies that are
relevant to
• the conservation and
• sustainable use of biological diversity or
• make use of genetic resources
and do not cause significant harm to the
environment.

Article 16 CBD
• Access and transfer to be provided under fair and
most favorable terms
• Access to genetic resources in exchange for access
to, and transfer of, technology that makes use of
those genetic resources
• Transfer includes technology protected by
intellectual property rights
• Transfer in accordance with international law

• 2001 – 2003: Ad Hoc Technical Expert Group
• Report on biodiversity considerations in design of
climate change strategies and activities
• Now: supplementary assessment on integration of
biodiversity in the implementation of adaptation
activities to climate change
• Meeting of technical experts in September 2005
• Report will be submitted to SBSTTA-11, in
December 2005

Conclusions
Opportunities for synergy exist…
in transferring technology
in designing targeted processes for fostering
transfer of technology
…but each process also has its own issues…
UNFCCC: mitigation technologies
CBD: access and benefit sharing
…and there are limitations to synergy
which require cooperation to minimize tradeoffs
