Regulation (EC) No 689/2008 of the European Parliament and of
the Council of 17 June 2008 concerning the export and import of
dangerous chemicals which will be replaced by Regulation (EU) No
649/2012 of the European Parliament and of the Council of 4 July

Regulation (EC) No 689/2008 has been mainly transposed into the
national legislation through provisions of the Law on Chemicals (OJ
MNE 18/12 )
The remaining provisions shall be transposed by planned secondary
legislation:
Rulebook on contents of the notification referred, the procedure and
timetable for implementing the procedure of prior notification
List of chemicals for the prior notification procedure
Rulebook on contents of the notification referred, the procedure and
timetable for implementing the PIC procedure
List of chemicals for the PIC procedure

COMPETENT AUTHORITIES
•Ministry of Sustainable Development and Tourism is competent for
drafting the legislation in this area and has general competence over
supervision of implementation of this legislation
•Environmental Protection Agency verifies the data from the notice
and after testing notify the country of export of chemicals.
•Environmental Protection Agency - notification and information
measures required for the import and export of chemicals requiring
prior informed consent
•Environmental Protection Agency - delivers a decision in connection
with the import of chemicals listed under the Rotterdam Convention to
the Secretariat of the Rotterdam Convention.

COMPETENT AUTHORITIES
•Administration of Customs responsible for controlling the import and
export of chemicals listed in Annex I
•Inspection supervision over the enforcement of import and export of
chemicals performs Environmental Inspector

IMPLEMENTATION
•
Established procedure about:
1.
Receiving notification of a proposed first export of a substance
subject to notification at least 30 days before the intended export
Notifying the competent authority of the transit country of the
chemicals in transit at least 15 days prior to the transit

QUESTIONS
