WHAT IS ACCEPTABLE?
Litter Code of Practice
The Environmental Protection Act 1990
• Imposes duties to keep specified land clear of litter and
refuse
• For local authorities to keep clean public highways for
which they are responsible
• The emphasis is on the consistent and appropriate
management of an area to keep it clean
• Also standards relating to graffiti and fly-posting.
Litter Code of Practice
It is an offence to throw down, drop or otherwise deposit,
and then leave, litter.
A person found guilty of the litter offence may be fined
up to £2,500 in a magistrates’ court.
An “authorised officer” can issue “fixed penalty notices”
as an alternative to prosecution.
Litter Clearing Notice and SLCN’s - now repealed.
Replaced with ASB alternatives.
