Patient Rights
• The basic rights of all people for independence
of expression, decision, action and concern for
personal dignity and human relationships are
always of great importance. During sickness,
their presence or absence becomes a vital factor
in survival and recovery. Therefore, the DMC
healthcare team is dedicated to providing our
patients with the best medical care and
information available.
• DMC will work together with our patients,
physicians, and hospitals to assure that high
quality medical care is provided.

Patient Rights
• DMC will provide patients with the names and
titles of those involved in their healthcare upon
request.
• Patients will receive information about their
illness, recovery, plan of care and other
healthcare choices.
• We will inform patients that they have the right
to appoint someone to make decisions for them
concerning their medical treatment, in the event
that they become unable to make such decisions.

General Information on Patient Rights
Patients have the right to:
• Information of hospital policies, rules and regulations relating to their
hospital stay
• Ask for help in understanding their hospital bill and any available
financial assistance
• Complain about their care or services; if the complaint is not resolved
patients can contact a DMC Patient Relations Representative
• Contact the DMC Compliance Hotline at: 1.888.484.9200
• Receive information about advance directives or durable power of
attorney
• File a compliant:
- With the State against a licensed or certified health care facility
- With the Joint Commission
- About the quality of healthcare at the DMC

Patient Rights
Access to care:
• DMC agrees to provide quality healthcare and accommodations
to all patients regardless of age, sex, race national origin,
handicap and sources of payment.
Respect and dignity:
• The patient, at all times and under all circumstances, has the
right to respectful care that recognizes their personal dignity and
individuality while respecting their personal values and belief.
Privacy and confidentiality:
• DMC patients can expect that all aspects of their care will be
treated confidentially, including their medical record. State and
federal laws and DMC operating policies protect the privacy of
our patient’s medical information.

Personal safety:
• DMC physicians and other healthcare professionals are required to
provide medical care that follows sound medical and ethical practices.
Caregivers are NOT permitted to provide medical treatment that is outside
the standard of care or which could be harmful to patients.
Identity of caregivers:
• Patients have the right to know the identity and professional status of
individuals providing services to them, including which physician is
primarily responsible for their care.
Communication:
• Patients have the right to visitors, phone calls or written communication
unless restricted by policies or procedures. Patients may communicate
with and know the qualification of their healthcare providers (When a
patient does not speak or understand spoken English, an interpreter will
be provided).

Information and consent:
• Patients have the right to obtain complete, current information
concerning their diagnosis, treatment, risks, benefits and any known
alternatives, before agreeing to any treatment. This information will be
communicated in a way the patient can understand (This process
protects our patients’ right to accept or refuse treatment).
Consultation:
• Patients have the right to request a consultation with a specialist and
to seek a second opinion at their own expense.
Transfer and continuity of care:
• Patients are involved in discharge planning including healthcare needs
and what to expect when they leave a DMC hospital.
Hospital charges:
• Patients have the right to request and receive a detailed explanation of
their bill for services rendered, regardless of the source of payment.

Patient and Family Responsibilities
Patients have certain responsibilities in their plan of care such
as:
• Helping the physicians and other healthcare professionals by sharing
their complete medical history, including current medications.
• Respecting the dignity and right to privacy of other patients.
• Moving to another room when necessary, either to aid in their own
recovery or that of another patient.
• Following DMC rules and regulations.
• Sharing information about their health insurance and ability to meet
financial obligations.
• Refraining from smoking in the hospital and on hospital property,
including parking lots and garages and ramps.

HIPAA
HIPAA is a set of rules to be followed by doctors, hospitals and
other health care providers. HIPAA helps ensure that all medical
records, medical billing, and patient accounts meet certain privacy
standards with regard to documentation, handling and disclosure.
In addition, HIPAA requires that all patients, upon request be able to
access their own medical records, correct errors or omissions, and
be informed how their personal information is shared or used.
Other provisions involve notification of privacy procedures to the
patient.
• HIPAA privacy rule:
- The HIPAA privacy rule protects the privacy of all health information
• HIPAA security rule:
- The HIPAA security rule protects the security of electronic health
information

EMTALA
EMTALA was originally enacted to address the concern over the
availability of emergency health care services to the poor and
uninsured. EMTALA addresses the problems of:
• “Patient dumping” where hospital emergency rooms deny uninsured
patients the same treatment provided to paying patients, either by
refusing care or by transferring uninsured patients to other facilities.
• Medicare providers, including the DMC, are required to provide
medical screening and stabilizing treatment to any patient that seeks
care in its emergency rooms.
• Stabilizing a patient also applies to a pregnant female experiencing
contractions.
• DMC will not transfer patients who are potentially unstable, if we
have the capabilities and the physical capacity to treat a patient.
• Patients may be transferred under EMTALA for medical necessity.

Safe Haven Act
The Safe Haven Act - allows a parent to legally
surrender newborn infants to a hospital, police
station, etc. without facing criminal prosecution:
• The DMC employee receiving an infant under the Safe Haven
Act will immediately notify Security.
• DMC will initiate all actions authorized by law to achieve the
safety and placement of a newborn infant in a manner
consistent with the best interests of accepting a newborn.
• DMC will make every effort to gather relevant information from
the parent relating to the infant.

Organ Procurement
There is an urgent need for organ and tissue donation. The
DMC will raise awareness with our patients, and family
members. A Gift of Life Coordinator may approach the family to
discuss a donation:
• The patient, the patient’s family or the patient’s advocate will have
final consent regarding organ and tissue donation.
• The patient’s medical condition will determine what organs or tissues
may be donated.
• Organ or tissue donation does not interfere with funeral plans.
• There is no cost for organ or tissue donations.
• Organs and tissues suitable for donation include heart valves, eyes,
corneas, bones, skin, ligaments, tendons and blood vessels.
