Marketing - Conclusions?
The same laws that govern Employee and Employer relationships exists
through the use of social media and non-social media.
An employer cannot require access to an employee’s non-public,
personal social media Website content.
This area becomes gray when the employee chooses to discuss
information about the employer. When this occurs, the company’s
privacy and information distributions policies come into play. Over time,
the laws surrounding the use of social media and its use by a company’s
employees will continue to become more defined
The key to this is for employers to have clearly defined policies about
this already in place. For example, can an employee publicly discuss
company performance, contracts, company culture, company clients,
etc…? All companies should have policies dealing with what an
employee may discuss and disseminate publicly.

Marketing - Conclusions
Since Colorado is an Employee-At-Will state, by law an employer can fire
an employee for any reason what-so-ever. However the same laws about
how the employer came to have the information that they acted upon
and the circumstances surrounding a termination may leave any
employer open to legal action, especially if improprieties took place.
All companies should carefully read the privacy policies and terms and
conditions when beginning to utilize any type of social media for the
dissemination of information. You may be giving up some rights to this
content when you open these social media accounts.
When using social media, remember that you are publishing, permanent
information on a global basis. Even if you delete this information it is
likely that this information will not be able to be completely removed.
Given the scale of this dissemination of information, larger lawsuits may
occur than if the information were simple sent in a letter or email.
