Court System
• Structured as a hierarchy.
 Some courts are higher then others.
• Depending on seriousness of offense.
 Different courts in the hierarchy will deal with different cases.
• Two basic types of Court System.

State Court

Deals with bulk of disputes and offenses.
Three Levels
 Magistrates Court (Local Court)




Magistrate decides verdict.
Minor disputes
Civil amounts less than $40,000, theft and drink-driving.
Magistrate will decide if case needs to go to higher court.
 District Court




Hears the appeals from the Magistrates.
More Serious Cases such as, Civil Disputes up to $250,000
Criminal offenses such as armed robbery, rape and fraud.
May have judge and/or jury.

Supreme Court
 Highest Court
 Two Divisions
 Trial Court
 Deals with Civil Cases over $250,000
 Murder, manslaughter, and serious drug offenses.
 Uses a Jury.
 Court of Appeal
 Deals with cases that have already passed through
the lower Courts, because parties was not satisfied
with the result.
Federal Courts

 The Family Courts
 Looks after Divorce and issues relating to divorce.
 Financial
 Property
 Child custody
 The Federal Courts
 Any breach of Federal Law
 Bankrupt, and trades practices to immigration and international
relations
 The High court
 Highest Court in Australia
 Takes care of all cases that have went through all lower courts and parties are still
not satisfied.
 Deals with constitutional and commonwealth matters
Funny Laws
• It is illegal to wear hot pink pants after midday Sunday.
• You must have a neck to knee swimsuit in order to swim at
Brighton Beach.
• Taxi cabs are required to carry a bale of hay in trunk.
• Only licensed electricians may change a light bulb.
• Illegal to crush beer cans between yours breast in the pub.
