What isTherapeutic
Jurisprudence?
Therapeutic jurisprudence, as
the study of the role of the
law as a therapeutic agent,
concerns itself with the
human, emotional,
psychological side of the law
and the legal process.
It’s Offspring…
 Drug
treatment courts
 DWI/DUI courts
 Veterans courts
 Mental health courts
 Domestic violence courts
and so on…
It’s Intent…
 …to
ensure the law’s
application in more
therapeutic ways while
respecting the mandates of
justice, due process and legal
accountability.
Further…
…to
regard the law as a
social force that can
produce behaviors and
consequences.
Its Key Characteristics
Rehabilitation
using sound
clinical intervention
Behavior
modification using
proven contingency
management techniques
It’s Key Characteristics
 The
blending of rehabilitation
services into the legal response and
the legal response into rehabilitation
services
 The
recognition that the entire team,
not merely treatment, is in the
business of supporting therapeutic
change
It’s Key Characteristics
 The
recognition that the rehabilitation
of addicted offenders must be a
holistic, comprehensive process
 The
understanding that “it takes a
village…” and that only an integrated
approach will ensure successful
rehabilitation
It’s Key Characteristics
 Team
consensus that supports
“what is in the best interest of
the client and the community”
A
team that understands the
value of coercion and motivation
to change in addicted
populations
It’s Key Characteristics
 Team
communication that is
open and honest
A
“staffing” mechanism that
prepares the judge to have
meaningful and therapeutic
interactions in the courtroom

The trust we place in someone
comes primarily from the following
sources:



Competence- Competence based trust reflects
confidence in others to do their jobs
Character- Character based trust pertains to our
confidence in team members’ integrity
Critique- Critique based trust reflects our
confidence that others will not pass judgement too
quickly
What is a Personal
Compact?
A personal compact is the reciprocal obligation and
mutual commitment, both stated and implied between
team members and with clients.
Personal compacts have three dimensions: formal,
psychological and social. Team members and clients
determine their responsibilities, level of commitment and
their support of the drug court values along these
dimensions.
